Staff Attorney, Climate and Energy
Earthjustice is seeking an experienced attorney to join the Climate and Energy team in its Northeast office. The Climate and Energy work is at the heart of Earthjustice’s efforts to cut greenhouse gas emissions and prevent catastrophic climate change. The attorney selected for this position will work closely with other professionals (attorneys, policy analysts, communications experts) to force a shift from dirty to clean energy. The position will be based in our office in New York City.

The Climate and Energy work in the Northeast Office uses litigation and administrative advocacy to end the region’s reliance on fossil fuels and speed the transition to clean, renewable energy for power generation, home heating and cooking, and transportation. Our docket includes involvement in utility ratemaking proceedings in Albany, litigation to prevent construction of additional fossil fuel infrastructure, and other advocacy activities to foster a more rapid change to a zero emission future, especially in New York and New Jersey.
Applicants must be ready and able to develop and lead litigation from day one. The ideal candidate for this position will have extensive and successful experience with most aspects of judicial and administrative proceedings—including developing cases, conducting discovery, assisting with expert reports, motion practice, evidentiary hearings, and post-hearing briefing. - Manage new and existing cases from start to finish, performing all aspects of litigation, including: drafting pleadings, motions and briefs; conducting discovery; presenting oral arguments; and handling appeals.
- Conduct factual investigations and develop legal theories for possible advocacy or litigation advancing the goals of our Climate and Energy work.
- Assist in growing the Northeast Office’s work in fostering an equitable pathway to swift cuts to greenhouse gas emissions.
- Serve as the office’s principal representative in Public Service Commission proceedings in Albany.
- Join other staff in long-term planning, strategy development, goal-setting, and work plan management that advances a collective vision for future Climate and Energy work, generally, and zero-emission advocacy, specifically.
- Participate actively in organizational and office efforts to create a diverse, equitable, and inclusive workplace.
- Supervise the work of Associate Attorneys, Law Clerks, and Litigation Assistants, who are part of the litigation team.
- Develop and manage relationships with co-counsel, clients, and coalition partners, including increasing the Northeast Office’s ties to overburdened and marginalized communities.
- Work effectively with other departments within Earthjustice, including Communications, Development, and Policy and Legislation.
- Admitted or willing to seek admission to the New York bar.
- At least seven years of legal experience, including substantial experience with litigation and administrative proceedings.
- Experience in pre-trial and administrative proceedings (e.g., regulatory comments; preparation of fact and expert witnesses; motion practice); evidentiary hearings; and post-trial or post-hearing briefing. Experience in appellate litigation is a plus.
- Excellent research, analysis, writing, and oral advocacy skills.
- Demonstrated ability to think strategically and to implement collective plans.

- Ability to work both independently and in collaboration with others.

- Ability and willingness to travel for case work, court and regulatory proceedings, and presentations, including spending substantial time, as needed, in Albany, NY to participate in proceedings before the state’s Public Service Commission.
